Alabama Law: Do I Have a Case?

Do I have a case? There is no shame in asking this question. I talk to clients, here in Mobile and surrounding counties, that seem down right embarrassed to ask it. I tell them that the law is here to help them. Their rights are never anything they should be embarrassed to ask about.

Add to this, it doesn’t cost you anything out of your pocket to ask. That is right, most attorneys who do what I do (practice personal injury law) will talk to you for free. If they don’t, find another lawyer.

Here are a few things you need to know about Alabama law.

  • If you are not injured, there is no case. That you could have been hurt is not enough to bring a lawsuit.
  • An injury alone is not enough. Someone must have done something wrong. Now this can be that they didn’t put up the safeguards to prevent the injury, but there must be something that makes it their fault.
  • You must bring legal action within 2 years of the injury. It is called the statute of limitations and getting around it is extremely difficult if not impossible. It is the law. Some states have even shorter periods.

Now the next question I get is:  What is my case worth?  That is tricky since each case is based on its own specific facts, and many of those facts will not be known until we investigate the case. This is where experience comes in to play. I will give you one fact that seems to surprise many of my clients: where you file a lawsuit can determine its value. It is true. Juries in some counties tend to award more than in other counties.
