Traffic Wreck: What You Post Can Cost You $$$$$

If you are in a wreck and want that check, DO NOT POST ON SOCIAL MEDIA. I guess I have said this a thousand times. Now, one thousand and one, DO NOT POST ON SOCIAL MEDIA.

The reason should be obvious: insurance adjusters will read your Facebook, Instagram, or TikTok. Even a post that is not about your accident can show you being active and, therefore, not appearing to be seriously hurt.

One story I heard had a friend writing, “Sorry about your accident. I’m so glad you were still able to come to my party. You’re a dancing machine!!!” Not quite an endorsement that you need long-term care.

The problem has gotten so bad that a Georgia attorney is having clients sign a document stating that they will be dropped as clients if they post.

I tell clients to watch out for the PPCs. So, here is my advice.

  • No Posting
  • No Pictures
  • No Comments

And don’t think deleting a post will fix everything. Now, insurance adjusters are arguing that you were trying to hide and even destroy evidence—a very serious charge.

I see this mostly affecting traffic accidents, but my advice is true for slip-and-fall injuries, on-the-job injuries, and almost any injury for which you expect the wrongdoer to pay.

One other note of caution: Be skeptical of anyone you do not know who asks to “friend” you. Investigators will often use this trick to access your profile. If you let them in, all that personal information can be used against you. Remember, here in Alabama, if you are even 1% at fault for the accident, you will collect nothing.
