Can I have PTSD after a car wreck? Can I collect?

Allen Ritchie • August 30, 2024

Question: My sister had a bad car wreck earlier this year. As I see her this Labor Day, anything I should look for?

JASON: Do this. Check if she suffers from PTSD. Just like so many of our veterans, a traumatic event, like war or a car wreck, can cause deep emotional scars.

Post-Traumatic Stress Disorder (PTSD) can also significantly impact your legal case by getting you compensation for your treatment.

Here are some signs to look for:

Flashbacks and Intrusive Memories/Nightmares

Does she relive the car crash? Intrusive thoughts can be crippling, preventing the victim from living a more normal life.

Avoiding People and Places

One of a victim’s coping measures can be to avoid triggers of the event. Do you see her pulling back from people or activities? Does she not go to some of the places she used to enjoy? These traits can greatly diminish the victim’s quality of life.

Emotional Numbing

Another way some victims cope is to shut off positive emotions—joy, laughter, and a sense of well-being. This often shows itself as the person being detached or uninvolved. Does it appear she is spending a great deal of time alone?

Increased Irritability

Just as your sister might not feel joy, she could also show signs of increased irritability and even paranoia. Often, the person living with PTSD can be overly nervous and on edge.

Increased Negative Thoughts

Does she show signs of guilt, shame, or self-blame because of the accident? These emotions can significantly impact individuals with PTSD. This is true even if the accident was not her fault.

Physical Problems

PTSD can also cause physical symptoms. Some examples are chronic pain, stomach trouble, and even blistering headaches. These can be caused by stress after the accident, especially if there are no obvious physical reasons. Inquire about a lack of sleep. This is extremely common in cases of PTSD.

In summary, look for changes in your sister and in her relationships with co-workers, neighbors, and other relatives. As to finances, if your sister is suffering because of PTSD, she may be entitled to money from the person who hit her.
