Alabama Law and Your Kid Being Hurt Playing Sports

Allen Ritchie • September 30, 2024

Question:  If my kid is hurt playing football, what can I do under Alabama law?

JASON: Alabama loves its football. OK, that’s not the most shocking statement I have ever made. But here is what might surprise you. Alabama is at the forefront of protecting children in football and, in fact, all sports.

Alabama was the first state to pass a law requiring coaches, even volunteers, who work with children under 14 to complete a training course in injury prevention. This comprehensive course covers topics such as concussions, muscle strains, and heat exhaustion and is peer-reviewed by professionals.

This initiative was developed to ensure that volunteer parents, who often coach kids’ teams, have the necessary training to keep children safe. The course is provided free of charge.

Here is the part that might impact your case. In Alabama, it is a legal requirement for coaches working with children to complete this training.

In terms of legal cases involving children’s sports, they typically revolve around defective equipment or failure to adhere to safety protocols. Common injuries include concussions, eye injuries, and fractures.

If a waiver has been signed, it may not necessarily prevent legal action, especially in cases of gross negligence or involvement of third-party groups such as equipment manufacturers.

In the event of a sports-related injury, seeking medical attention is the top priority. It’s also advisable to gather evidence, such as pictures and witness names, and to report the incident to the relevant school or organization so an official report can be created.

If the injury is severe, don’t be afraid to speak with a personal injury attorney to learn about your rights. Some injuries can be life-altering, and your child’s rights need to be protected.
